Following are some of the many recent updates featured in PPC’s 1040 Deskbook:

  • Prior Year Legislation. Throughout, we incorporated changes and provided compliance guidance for legislative provisions that are first effective in 2011 from the Tax Increase Prevention and Reconciliation Act of 2005 (TIPRA), Hiring Incentives to Restore Employment Act (HIRE Act), Patient Protection and Affordable Care Act as amended by the Health Care and Education Reconciliation Act of 2010 (collectively referred to as 2010 Health Care Act), Small Business Jobs Act of 2010 (2010 Small Business Act), and the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 (2010 Tax Relief Act).
  • Investment Transactions. Beginning in 2011, Form 8949 (Sales and Other Dispositions of Capital Assets) is used to report sales and dispositions of stocks and other capital assets. We discuss and demonstrate the use of Form 8949 which replaces Schedule D-1. We also discuss the new investment basis reporting requirements for brokers and the double-category transition rules.
  • Employee Stock Purchase Plans (ESPPs). Employee Stock Purchase Plans (ESPPs) allow employees to purchase their employer’s stock at a discounted price. We added coverage of this popular fringe benefit to the Deskbook.
  • Earned Income Credits. The IRS has increased its scrutiny of claimed earned income credits (EIC). We discuss the enhanced due diligence requirements for tax preparers for claiming the EIC and the Form 8867 (Paid Preparer’s Earned Income Credit Checklist) for claiming the EIC in the Deskbook.
  • Passive Activities. Individual taxpayers are now required to disclose groupings and re-groupings of certain passive activities within their tax return. The Deskbook has been updated to reflect these new reporting requirements.
  • Basis in an S Corporation. There is now a requirement for taxpayers to include a disclosure calculation of their tax basis in any S Corporation stock when a pass-through loss is claimed relative to that stock. We discuss this new reporting requirement in the Deskbook.
  • Excess Losses from Farming Transactions. Farmers who receive certain government subsidized payments are limited in the deductibility of their losses from farming activities. The IRS has released informal guidance regarding the mechanics of the loss reduction rules. We expanded the Deskbook’s discussion of these rules based on recent information from the IRS.
  • Professional Gamblers. New guidance and court decisions continue to be released regarding the deductibility of expenses by “professional gamblers.” We expanded our discussion of this topic in the Deskbook for recent court decisions and newly released guidance.
  • Electric Vehicle Credit. The argument that golf carts modified for use on public roads qualify for a tax credit has been dismissed by the IRS. The Deskbook has been updated to reflect recent IRS guidance indicating golf carts are designed primarily for off-road use and do not qualify for an electric vehicle credit.
  • Nonbusiness Energy Credits.  The credit amounts and limitations for most qualifying nonbusiness energy property have been reduced for 2011.  The Deskbook discusses these new limitations for this popular residential energy credit.
